1. BUSINESS ACTIVITY

We rent in short terms our superior furnished apartment, with personalized services for international travellers and individuals. Our apartment is located in the most desirable central location in Aix-en-Provence City.
 All short term rentals include personalized services such as maintenance and perfect knowledge of the property, welcoming and advises for guests during the stay

3. WORK ON YOUR REQUEST 

We are committed to responding to all requests for information as soon as possible. We will make a complete proposition for rental on the apartment according to availability.
Each rental proposition will include a description of the apartment, a map of the area, a list of charges and services included and rental terms.

4. DURATION OF STAY 

The minimum stay in the apartment is based on one Week rental, for 7 nights during the High season rental for the following months and rental periods: March, April, May June, July, August, September, October, Thanksgiving week in November, Christmas week and New Year Eve week.
We reserve the right to not accept rental demands under the minimum stay required.

5. BOOKING CONFIRMATION AND DEPOSIT 

5.1

Before committing on a booking, you must contact us by email to obtain confirmation that the apartment is available for the date required. To reserve your future Aix en Provence pied à terre, you will fill the "contact" form, with the rental period clearly indicated, the total number of agreed guests occupancy.

5.2

Reservation of your apartment will only be confirmed upon receipt of a 30% amount of the total price non refundable deposit of the agreed rental. Your reservation is firm with the selected dates and cannot be changed or postponed for any reason. Upon reception of our written reservation confirmation and the reservation deposit, we will send you details concerning the apartment including sleeping arrangements organized for your arrival and the arrival conditions. Please review it to ensure that the reservation is correct..

5.3

The person who has signed the Booking Request Form is responsible for the payment price on the temporary rental and the must comply as with all members of his party to the general rental conditions. A binding rental contract between the person who has signed the Booking Request Form and We, will be made only when we issue a Booking Confirmation.

5.4

Bookings cannot be accepted from persons under 18 years of age at the time of booking. We reserve the right to refuse a booking without giving any reason.

6. PAYMENT

6.1 Deposit reservation: 

We accept cheques or credit card or bank wire transfers. We do not cover the possible extra banks fees or charges due to wire transfer transaction. All rental amount paid by wire transfer has to correspond to the deposit amount required (with a net payment).
Cash is accepted.

6.2 Final Payment: 

We accept cash. The final balance payment is due upon your arrival in Aix en Provence, and not later than the first day of the rental. The short term rental contract is signed and return by you. Failure to pay the balance for rental on time will constitute cancellation and the tenant will have no right and no title to stay in the property. If the tenant is already in the property, he has to leave it at once.

6.3

Receipt of payment and deposit of this payment shall not constitute acceptance of any booking. A binding contract exists only when we issue a Confirmation of reservation.

7. PRICE

 7.1

The price given is exclusively in EUROS currency.
 The rent is prorated per night less according the length of the stay on Weekly basis ( 7 Nights) for stays from minimum 7 nights or Monthly basis ( 30 Nights) for stay of minimum 30 nights, unless otherwise stated.
 All rates published by us can be changed without notice
.

7.2

Our apartment is rented fully furnished and equipped with all major electrical appliances: refrigerator, oven, microwave, coffee-maker, toaster, electrical kettle, iron and iron board, hairdryer, dishwasher, washer/dryer,Internet colour TV with remote control, CD player.
 The price includes quality linen and towels, some bathroom supplies, toilet paper, basic cleaning products, detergent for dishwasher. 
 

For health and allergy reasons, we do not provide detergent for washing machine.

7.3 Rates include:

 Electricity consumption up to 100KWh for one week rental. Over one week the power consumption is in addition to the rental fee.
Cable TV offering all main international channels.
High Speed internet with unlimited connection. Please note that we cannot be held responsible for internet network malfunctions nor with the possible incompatibility between your laptop and our internet modem access. Hot line: 12h/day telephone number for emergencies. Personalized welcome at your arrival.
 We insures our apartment rental.

The property itself and its furniture and equipment are covered by insurance, in case of fire, water leak, burglary or window glass breakages.
 Your belongings are not covered by the property insurance. This insurance does not cover guest luggage, personal belongings, and valued objects.
 This insurance does not cover personal civil injuries or damages
.

7.4 Rental prices do not include :

 Electricity over one week rental.
Cell phone consumption for short local numbers calls and specific international calls.
Extra Services on request such as: Airport or train transfer to the properties, extra housekeeping not stated on the rental terms, breakfast & catering deliveries, mobile rental, internet personal assistance, baby sitting, personalized laundry. Insurance for guests' luggage, cash, valuables and civil injuries: Please contact your insurance agent before departure

8. SECURITY DEPOSIT Always required

600 Euros security deposit.
This security deposit by cash is required on day of arrival, to cover the cost of any damage, breakage, cost of telephone or/and electricity consumption (over 100KW for weekly rental, electricity according to meter for monthly rental) during the length of stay. As for security, we reserve the right to required for higher amount of security deposit depending the total number of guests in the party.If after completion of the inventory, nothing is reported damaged, lost or broken, the security deposit will be returned the day of departure from the property till 3 weeks later. Delays may caused while we are waiting to receive bills from providers.
If there is damage, the security deposit will be forwarded to the client within 3 weeks, after deduction of repairs/replacement costs or supplementary cleaning resulting from an insufficient state of cleanliness
.

9. ARRIVAL AND DEPARTURE TIME 

Concerning all reservations, your arrival information will be required in advance. For arrival, the check in time is planed from 3.00 pm to 6:00 pm. For departure, the check out time is planed for 10.00 pm.
 If these times are difficult please advise us at the time of booking. If your arrival is delayed you must inform us so that suitable arrangements can be made for entry to your rental accommodation. We cannot be held responsible for delayed arrival or cancelled flights in regards with the rental of the apartment
.

9.1 Check in time: 3.00 pm to 6.00 pm. 

The initial check in time for the apartment is planned on your arrival day at 3:00p.m., especially when the apartment is rented the night before your arrival. This procedure is applied strictly out of respect for the check out of previous tenants and in order to prepare and organize your apartment by our staff to welcome you in the best conditions.
 However, if the apartment is not rented the night before your arrival, we allow possible early check in with immediate access to the property, upon our written agreement. For arrival after 6:00pm, you will have 50 euros to pay for late arrival.

9.2 Check out time: 10.00 am.

The initial check out time is planned at 10am, and has to be strictly respected with keys returned. In case you have an early departure (any day of the week) we will arrange directly with you the day before your departure for this key return. In case of non-respect of check out time, we reserve the right to bill you a late departure penalty. However, if the property is not rented the same day of your initial departure date, upon our agreement, we authorize the tenant for a later departure at no extra cost.

9.3 Access to your apartment:

Our representative or we, will provide you the keys, and will go with you to your apartment, to help you to settle in, to explain how to work all electrical appliances, and to give you recommendations on local shops and restaurants.
 We or our representatives can access the rental accommodation at any reasonable time during any occupancy for the purposes of inspection, maintenance, or emergencies.

10. NUMBER OF PEOPLE USING THE TEMPORARY ACCOMMODATION

Only those persons named on the booking form and total numbers of guests agreed upon in the rental forms may use the property without prior agreement. The number of people staying at the property must not exceed the number of sleeping places indicated in the booking confirmation (number also including infants under two years). In the event that the maximum number is exceeded without prior agreement, we reserve the right to refuse or revoke the contract at its sole discretion.

11. BEHAVIOUR 

The person signing the contract is responsible for the correct and decent behaviour of his/her party. Should you and your party not behave in such a manner, we may at its absolute discretion ask you and your party to vacate the property without a refund of the rent.

 

12. SOCIAL, BUSINESS AND OTHER FUNCTIONS...

It is our policy to allow only residential use and not to allow social, business, trade events and other functions (exhibitions, trade desks, large receptions, large cocktail parties) on the property without our consent.

13. YOUR RESPONSABLITIES 

You must keep the temporary rental accommodation and all furniture, fittings, effects, facilities and equipment in the same state of repair and condition as at the commencement of the stay, and leave the rental accommodation in the same state of cleanliness and general order in which it was found. You are responsible for all damage or loss which occurs to the property or its contents during your occupation, and will be responsible for paying appropriate compensation to us as representative for the Property Owner in the event of damage.

 

14. CHILDREN

We are happy to welcome families with children and infants. We even have baby bed (30 euros) and high chairs (20 euros) or stroller (50) euros, if you request them, available for your use. We would like to draw your attention as parents and as persons responsible for your little ones to their good behaviour. You are entirely responsible for the good behaviour of these children. Whatever is the reason, in case there is damage, be it voluntary or accidental, we reserve the right to charge you for all damages caused by your children or the children of your guests visiting you in the rental property. A complete control of the state of the apartment will be made after each departure.

 

15. PETS

For hygiene and sanitary reasons, as well as allergy reasons for other guests, no animals are allowed in our apartment. 

 

16. SMOKING 

As sanitary and healthy our apartment (terrace included) is a non smoking property.

17. ALTERATIONS OR CANCELLATION INITIATED BY US 

In the unlikely event that it is necessary to make an alteration to or cancel the temporary rental accommodation specified in the booking confirmation form we will respectfully inform you as soon as possible and, if requested, we will try to arrange alternative period of accommodation.

18. CANCELLATION BY YOU

18.1

Any cancellation by you (for whatever reason) must be in writing.
The effective date of cancellation is the date on which written notification is received by us in Aix (M, Me Roquigny, 5 rue des bartavelles, 13540 Puyricard. France).

18.2

If you cancel at any time between the day after you received the Confirmation of Reservation and the day before the arrival day, you will lose your Deposit Reservation.

18.3

If you cancel less than one month before the rental, you will pay the whole amount. If you cancel or do not arrive at the first day of the stay (no show), or if you vacate the property before the end of the rental period, or if the booking is cancelled by us due to non payment, we are entitled to the full rental cost from you. For stays of more than one month, special departure conditions may be applicable upon particular prior booking conditions.

18.4

To avoid cancellation fees, we strongly recommend you to book only when your travel dates are firm and to ask your travel agent for cancellation insurance.

19. AMENDMENTS BY YOU 

Upon receipt of your Booking Confirmation, please check the details to make sure they are correct. If the day after your booking has been accepted and you require us to amend it in any way, we reserve the right to void your reservation rental dates as a cancellation of reservation. We particularly reserve the right to not accept at any time, supplemental guest who are not listed on the reservation form.
 Ex: If you have reserved an apartment for 2 persons, a third person will not be allowed to stay in the apartment, without our express agreement.

20. COMPLAINTS 

in the unlikely event that you are disappointed with the temporary accommodation, you must contact us at once. We will try to solve the problem. If after that you still feel that the problem has not been resolved to your reasonable satisfaction you should within 7 days of returning from Aix en Provence, put your comments in writing to us. If you vacate the property before the end of the rental period you shall lose any rights to compensation.

 

21. OUR LIABILITY

21.1

We shall not be responsible for the death of or personal injury of you or any person named on the Booking Form and Confirmation of reservation or other person at the property unless this results from the proven negligence of ourselves, or our employees.

21.2

We shall not be liable for any loss, breach or delay due to any cause beyond our reasonable control including though not limited to act of God, explosion, flood, tempest, fire or accident, war or threat of war, civil disturbance, acts, restrictions, regulations, by-laws, or measures of any kind on the part of any governmental or local authority, strikes, lockouts, or other industrial actions or disputes or adverse weather conditions. In any such case we shall be entitled to treat the contract as discharged.

21.3

In the event of such discharge our liability shall be limited to the return of sums paid to us in respect of the unused portion of the rent calculated on a prorata night basis.

21.4

We cannot be held responsible for breakdown of mechanical equipment of the accommodation or common to the building, such as pumps, boilers, lift, electric doors, heater systems, TV antenna etc., nor for failure of public utilities such as water, gas and electricity, Internet TV.

21.5

We are not responsible for noise or disturbance originating beyond the boundaries of the temporary accommodation or which is beyond our control.

22. INFORMATION AND PHOTOGRAPHS 

22.1

You must accept that minor differences between the photograph/illustration/text used and the actual property may arise, concerning element of comfort, decoration and furnishings.

22.2

We reserve the right to make modifications to the property that are considered necessary in the light of operating requirements. In the interest of continued improvement, We reserve the right to alter furniture, fittings, amenities, facilities, or any part of any activities, either advertised or previously available, without prior notice.

22.3

If material changes occur after your booking has been confirmed we will advise you if there is time before your departure.

22.4

All Photographs taken at our apartment, description texts, floor plans are exclusively our property and protected by Copyrights. Partial or full photographs, texts cannot be used or sold for profit without prior authorisation and our permission.

23. CLEANLINESS, HYGIENE & QUALITY LINEN 

The apartment will be cleaned, prepared, reviewed for your arrival to welcome you in the best condition. As a respectful tenant, you must leave it clean throughout at the end of the rental period. All linens are our property. All linen is carefully sanitary washed, dried, ironed and freshly changed for every arrival. For that reason we would thank you to keep and maintain in correct condition all linens, comforter, duvets, pillows and towels. We reserve the right to charge a penalty for non respect and/or misuse of linen. The housekeeping assistance will be exclusively performed by our own team, during the afternoon between 10am and 3pm for your morning comfort. All our team is trustworthy, specially trained and organized as best as possible for your convenience. If you require more frequent or additional linen changes it will be possible to organize in advance at extra charges.

24. SECURITY RESPONSABILITY AND VALUABLES

Any valuables left at the property are left at your own risk. We are not responsible for their loss. The apartment is in central Aix en Provence and as with all properties in prime locations; there may be a risk of burglary. Entrance door must be always locked with keys when you are outside as well as inside the accommodation. Where provided, safes should be used and proper care taken against theft and burglary. We accept no responsibility for any loss, damage or consequential losses due to theft or any other security related incident howsoever caused.

 

25. INSURANCE 

The property itself and its furniture and equipment are covered by insurance, in case of fire, water leak and burglary or window glass breakages.
Your belongings are not covered by the property insurance.
We strongly recommend you to insure yourself, every member of your party, your luggage and your party's luggage, cash, jewels, valuables, etc. by a comprehensive travel insurance including also personal responsibility.
Please contact your insurance agent or your travel agent before leaving your permanent home.

26. LAW

All contractual obligations arising out of these booking rental conditions shall be deemed to come into existence in Aix en Provence, FRANCE, and be subject to French law and the exclusive jurisdiction of the Aix en Provence courts. .

 

27. COPYRIGHT

 

The entire contents of our website are protected according to the provisions of the Intellectual Property Code, including all written text featured on the site, screen presentation, operating software and all logos, images, photos, graphics and movies, whatever their form. You are reminded below of the provisions of Articles 335 (2) and 335 (3) of the Intellectual Property Code. Also, any use of the data contained on the site is at the sole liability of the user. We cannot under any circumstances or on any grounds be held liable for such use, whatever the consequences thereof. We shall not be liable for any error or omission on the site, and we reserve the right to modify, correct and/or complete its contents at any time, without notice. Any information which may be disclosed to us by users during their use of our web site is under no circumstances confidential, unless otherwise clearly indicated on our site.
 
 Relevant provisions of the Intellectual Property Code:
 
 Article 335 (2) - The publishing, in whole or in part, of any writings, musical composition, drawing, painting or other work, whether printed or engraved, in disregard of the laws and regulations on copyright ownership, shall constitute an infringement, and any infringement is a criminal offence. The infringement in France of works published in France or abroad is punishable by a term of up to two years' imprisonment and a fine of up to EUR 150,000.
